Terms of use

This is the agreement between you and 312.dev LLC, which publishes and runs Scrolly. By creating an account, posting anything, or uploading anything, you accept it. If you do not, do not use the app.

Who can use Scrolly

You have to be at least 13 years old. Scrolly is invite-only, so you also have to have been invited into a group by someone who is already in one. One account per person. Do not let anyone else use yours, and do not sign in as someone else.

Your account

You sign in with Apple, with Google, or with a code we email you. Keep access to whichever one you chose, because it is the only way back into your account. Tell us at scrolly@312.dev if you think someone else has got into it.

What you may not post

Scrolly groups are small and private, which is not a licence to post anything. The following are not allowed anywhere in the app, in a clip, an upload, a caption, a comment, a GIF, a username or a profile picture:

• Anything sexual involving a minor, in any form. This is the one rule with no judgement calls attached: it means an immediate ban and a report to the authorities.
• Sexually explicit or pornographic material.
• Harassment, bullying, threats, or content targeting a specific person to upset them.
• Hate speech, or content attacking people over race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation.
• Graphic violence, or content that glorifies or encourages violence or self-harm.
• Content that promotes or facilitates a crime, including the sale of drugs, weapons or stolen goods.
• Anyone's private information, including addresses, phone numbers, financial details, or images of a person who did not agree to be filmed.
• Impersonating another person.
• Spam, scams, phishing, malware, or bulk unsolicited posting.
• Content you do not have the right to post, including material that infringes somebody's copyright or trademark.

Do not attack the service either. No scraping, no automated access, no attempting to reach data belonging to a group you are not in, no reverse engineering, and no circumventing any limit the app applies.

Reporting, blocking, and what we do about it

Every clip and comment can be reported, and every member can be blocked. A report goes to the host of your group, who can delete the content and remove the person who posted it. A block hides you and the person you blocked from each other in both directions.

We also act ourselves. We can remove any content and close any account, with or without a report, when something breaks these rules. Content that sexually exploits a child is removed on sight and reported to the National Center for Missing and Exploited Children. For everything else, expect us to look at it within a few days. If you think we got a decision wrong, reply to us and say so. A person will read it.

Links to other platforms

Most of what people post in Scrolly is a link to a video hosted somewhere else. We do not store that video, and your device fetches it from the platform it lives on. That video belongs to whoever made it, and it is governed by the terms of the service hosting it, not by ours. Do not use Scrolly to route around a paywall, an age gate, or a platform's own rules.

Your content is yours

You keep every right you already had in what you post. You give us permission to store it, process it and show it to the other members of your group, and to make the technical copies that requires, such as generating a thumbnail. That permission exists only so the app can work. It is not exclusive, we make no money from it, and it ends when you delete the content or your account, except for copies already sitting in a backup, which age out on their own.

You are responsible for what you post, and you are telling us you have the right to post it.

Ending it

You can leave at any time. There is a page for deleting your account. We can suspend or close an account that breaks these rules, and we can stop running Scrolly entirely, in which case we will give you notice and a chance to get your things out.

No warranty, and the limit of what we owe you

Scrolly is free, and it is a side project run by a very small company. It is provided as it is, with no promise that it will work, stay available, keep your data, or suit any purpose. Back up anything you would be upset to lose.

To the fullest extent the law allows, 312.dev LLC is not liable for indirect, incidental or consequential damages, or for lost data or lost profits, arising out of your use of Scrolly. Some states do not allow that limit, in which case it does not apply to you.

Changes

If these terms change, the date at the top changes with them. If a change matters, we will tell you in the app before it takes effect. Continuing to use Scrolly after that means you accept the new version.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules, and any dispute goes to the state or federal courts located in Cook County, Illinois.
